MAJOR LEAGUE RULES Rule 21 MISCONDUCT(a) MISCONDUCT IN PLAYING BASEBALL. Any player or person connected with aclub who shall promise or agree to lose, or to attempt to lose, or to failto give his best efforts towards the winning of any baseball game withwhich he is or may be in any way concerned; or who shall intentionallyfail to give his best efforts towards the winning of any such baseballgame, or who shall solicit or attempt to induce any player or personconnected with a club to lose, or attempt to lose, or to fail to give hisbest efforts towards the winning of any baseball game with which such other player or person is or may be in any way connected; or who, beingsolicited by any person, shall fail to inform his Major League Presidentand the Commissioner.(b) GIFT FOR DEFEATING COMPETING CLUB. Any player or person connectedwith a club who shall offer or give any gift or reward to a player orperson connected with another club for services rendered or supposed tobe or to have been rendered in defeating or attempting to defeat acompeting club, and any player or person connected with a club whoshall solicit or accept from a player connected with another club anygifts or reward for any such services rendered, or supposed to have been rendered, or who having been offered any such gift or reward, shall fail to inform his League President or the Commissioner immediately of such offer, and of all facts and circumstances therewith,shall be declared ineligible for not less than three (3) years.(c) GIFTS TO UMPIRES Any player or person connected with a club, whoshall give, or offer to give, any gift or reward to an umpire for servicesrendered, or supposed to be or to have been rendered, in defeating orattempting to defeat a competing club, or for the umpire's decision onanything connected with the playing of a baseball game; and any umpirewho shall render, or promise or agree to render, any such decision otherwise than on its merits, or who shall solicit or accept such giftsor reward, or having been solicited to render any such decisionotherwise than on its merits, shall fail to inform the League Presidentor the Commissioner immediately of such offer or solicitation, and allfacts and circumstances therewith, shall be declared permanently ineligible.(d) BETTING ON BALL GAMES. Any player, umpire, or club official or employee, who shall bet any sum whatsoever upon any baseball game inconnection with which the bettor has no duty to perform shall be declaredineligible for one year. Any player, umpire, or club or league official or employee, who shallbet any sum whatsoever upon any baseball game in connection with whichthe bettor has a duty to perform shall be declared permanently ineligible.(e) VIOLENCE OR MISCONDUCT IN INTERLEAGUE GAMES. In case of any physicalattack or other violence upon an umpire by a player, or by an umpire upona player, or of other misconduct by an umpire or a player, during or inconnection with any interleague Major League game or any exhibition gameof a Major League Club with a club or team not a member of the same league,the Commissioner shall impose upon the offender or offenders such fine,suspension, ineligibility or other penalty, as the facts may warrant inthe judgement of the Commissioner.(f) OTHER MISCONDUCT. Nothing herein contained shall be construed asexclusively defining or otherwise limiting acts, transactions, practicesor conduct not to be in the best interests of Baseball; and any and allother acts, transactions, practices or conduct not to be in the bestinterests of Baseball are prohibited and shall be subject to suchpenalties, including permanent ineligibility, as the facts in theparticular case may warrant.(g) RULE TO BE KEPT POSTED. A printed copy of this Rule shall be keptposted in each clubhouse.

OFFICE OF THE COMMISSIONER OF BASEBALL 350 PARK AVENUE NEW YORK, NEW YORK________________________________ )In the Matter of: ) )Peter Edward Rose, Manager )Cincinnati Reds Baseball Club )________________________________) AGREEMENT AND RESOLUTION On March 6, 1989, the Commissioner of Baseball institutedan investigation of Peter Edward Rose, the field manager of theCincinnati Reds Baseball Club, concerning allegations that PeterEdward Rose engaged in conduct not in the best interests of baseball in violation of Major League Rule 21, including but notlimited to betting on Major League Baseball games in connectionwith which he had a duty to perform. The Commissioner engaged a special counsel to conduct a full,fair and confidential inquiry of the allegations against PeterEdward Rose. Peter Edward Rose was given notice of the allegationsand he and his counsel were generally apprised of the nature andprogress of the investigation. During the inquiry, Peter EdwardRose produced documents, gave handwriting exemplars and respondedto questions under oath upon oral deposition. During the deposition,the special counsel revealed key evidence gathered in the inquiryto Peter Edward Rose and his counsel. On May 9, 1989, the special counsel provided a 225-pagereport, accompanied by seven volumes of exhibits, to the Commissioner. On May 11, 1989 the Commissioner provided a copyof the Report to Peter Edward Rose and his counsel, and scheduleda hearing on May 25, 1989 to give Peter Edward Rose an opportunityto respond formally to the information in the report. Peter EdwardRose received, read and is aware of the contents of the Report.On May 19, 1989, Peter Edward Rose requested, and subsequently received, an extension of the hearing date until June 26, 1989.Peter Edward Rose acknowledges that the Commissioner has treatedhim fairly in this Agreement and has acted in good faith throughoutthe course of the investigation and proceedings. Peter Edward Rose will conclude these proceedings before theCommissioner without a hearing and the Commissioner will not makeany formal findings or determinations on any matter includingwithout limitation the allegation that Peter Edward Rose bet onany Major League Baseball game. The Commissioner has determinedthat the best interests of Baseball are served by a resolutionof this matter on the following agreed upon terms and conditions: 1. Peter Edward Rose recognizes, agrees and submits to thesole and exclusive jurisdiction of the Commissioner: A. To investigate, either upon complain or upon his owninitiative, any act, transaction or practice charged, alleged orsuspected to be not in the best interests of the national game ofBaseball; and B. To determine, after investigation, what preventive, remedial, or punitive action is appropriate in the premises, and totake such action as the case may be. 2. Counsel for Peter Edward Rose, upon his authority, haveexecuted a stipulation dismissing with prejudice the civil actionthat was originally filed in the Court of Common Pleas, HamitlonCounty, Ohio, captioned Peter Edward Rose v. A. Bartlett Giamatti,No. A8905178, and subsequently removed to the United States DistrictCourt from the Southern District of Ohio, Eastern Division, DocketNo. C-2-89-577. 3. Peter Edward Rose will not avail himself of the opportunityto participate in a hearing concerning the allegations against him,or otherwise offer any defense to those allegations. 4. Peter Edward Rose acknowledges that the Commissioner has afactual basis to impose the penalty provided herein, and herebyaccepts the penalty imposed on him by the Commissioner and agreesnot to challenge that penalty in court or otherwise. He also agreeshe will not institute any legal proceedings of any nature against theCommissioner of any of his representatives, either Major League orany Major League Club. 5. The commissioner recognizes and agrees that it is in thebest interests of the national game of Baseball that this matterbe resolved pursuant to his sole and exclusive authority under the Major League Agreement. THEREFORE, the Commissioner, recognizing the benefits toBaseball from a resolution of this matter, orders and directsthat Peter Edward Rose be subject to the following disciplinarysanctions, and Peter Edward Rose, recognizing the sole and exclusiveauthority of the Commissioner and that it is in his interest toresolve this matter without further proceedings, agrees to acceptthe following disciplinary sanctions imposed by the Commissioner. a. Peter Edward Rose is hereby declared permanently ineligiblein accordance with Major League Rule 21 and placed on the IneligibleList. b. Nothing in this Agreement shall deprive Peter Edward Rose ofthe rights under Major League Rule 15(c) to apply for reinstatement.Peter Edward Rose agrees not to challenge, appeal or otherwisecontest the decision of, or the procedure employed by, the Commissioner or any future Commissioner in the evaluation of anyapplication for reinstatement. c. Nothing in this agreement shall be deemed either anadmission or a denial by Peter Edward Rose of the allegationthat he bet on any Major League Baseball game. Neither the Commissioner nor Peter Edward Rose shall beprevented by this agreement from making any public statementrelating to this matter so long as no such public statementcontradicts the terms of this agreement and resolution.
